Legal
Terms and Conditions
§ 1 Scope
These General Terms and Conditions (GTC) apply to all agreements between SIT Operations GmbH (trading as “ST Munich”), Stendaler Straße 3, 74912 Kirchardt, Germany, registered with Amtsgericht Stuttgart under HRB 803936 (hereinafter the “Maison”), and the client regarding the individual creation of jewellery and high jewellery pieces.
These GTC apply exclusively. Deviating, conflicting or supplementary terms of the client shall become part of the agreement only if the Maison has expressly consented to their validity in writing.
§ 2 Conclusion of Contract
The presentation of the Maison’s services – in particular on this website and in the Bespoke configurator – does not constitute a legally binding offer but rather an invitation to submit a non-binding enquiry.
Upon receipt of your enquiry, a personal initial consultation takes place. On this basis, the Maison prepares an individual written offer. A contract is concluded only upon mutual signature of this individual offer or a corresponding order confirmation. Standard online-shop purchasing does not apply.
§ 3 Prices and Payment
The prices stated in the individual offer are inclusive of statutory value added tax.
Unless otherwise agreed, a deposit of 50 % of the total price is due upon order confirmation. The remaining balance is payable on handover of the piece.
§ 4 Delivery and Handover
Handover takes place, at the client’s choice, either in person by separate arrangement or by insured secure courier to an address designated by the client worldwide. Shipping and insurance costs are itemised separately in the individual offer.
The piece is handed over in the Maison box. Delivery or handover dates are binding only if expressly designated as binding in the individual offer; otherwise they are considered approximate.
§ 5 Retention of Title
The delivered piece remains the property of the Maison until the total price has been paid in full.
§ 6 Warranty
The statutory rights for defects apply (§§ 437 ff. BGB) with a limitation period of 24 months from handover. In the case of a justified defect, the Maison shall, at its discretion, remedy the defect either by repair or by remaking the piece.
Natural characteristics of the precious metals and gemstones used (such as characteristic inclusions, colour nuances or patina from wear) do not constitute defects, provided they do not conflict with the agreed specifications.
§ 7 Right of Withdrawal
For goods made to the client’s specifications, the right of withdrawal is excluded pursuant to § 312g (2) (1) BGB. All pieces created by the Maison are individual, one-of-a-kind commissions made to the client’s specifications and therefore fall under this exclusion.
§ 8 Data Protection
Information on the processing of personal data can be found in our Privacy Policy.
§ 9 Anti-Money-Laundering
The Maison is subject to obligations under the German Anti-Money-Laundering Act (Geldwäschegesetz, GwG). For transactions of 10,000 EUR or more (including connected payments made in instalments) we are required by law to identify the contracting party (§ 10 GwG). For cash payments, stricter identification obligations apply at lower thresholds pursuant to § 10 (5) GwG.
The client cooperates in such identification and, in particular, presents the necessary identification documents.
§ 10 Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The choice of German law does not deprive consumers of the protection afforded by mandatory provisions of their home jurisdiction.
The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is – to the extent legally permitted – Heilbronn, Germany.
§ 11 Severability
Should individual provisions of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the statutory regulation shall apply.
